Certain conditions and activities may result in an applicant not being eligible for a visa. Examples of this inadmissibility are:
- Medicine trade
- Overstaying a previous visa
- Practicing polygamy
- Support the overthrow of the government
- Submission of dummy documents
The consular officer will inform you as an applicant whether you are not entitled to a visa, whether there is a waiver of inadmissibility and what is the procedure for waiver.

Completed and signed form 1-130-Petition for foreign parents

- 2 Forms G-325A biography cards-completed and signed G-325A forms, one with your information and one with that of your fiance.
- A proof of your relationship-a copy of your marriage certificate.
- Previous marriage annulment documents – a copy of all annulment decrees, passed away certificates or annulment decrees if you or your fiance have ever been married.
- Color photos-a passport-style color photo of you and a passport-style color photo of your husband or wife, taken within 30 days from the date of this petition. - Documents Required For Applying For A K-3 Visa
The following documents must be presented by your spouse to the US Consulate in his home country when applying for a K-3 visa.
- Two copies of the form DS-156, application for a nonimmigrant visa
- A DS-156K, Visa Application Form For nonimmigrants
- Police certificates from all places lived for six months and longer, since they were 16 years old. Applicants whose passports were issued within six months after the visa interview can only provide the certificate from the passport office.
- Foreign police certificate-all applicants who have lived in another country for a year or more since the age of 16 must also provide police certificates for these countries.
- Birth certificates-originals and photocopies
- Marriage certificate for the spouse-original And photocopy for all marriage certificates, including all terminated marriages.
- Passed away and annulment certificates of all former spouses
- Medical examination (except vaccinations)
- A passport that is valid for travel to the United States and the validity date of which exceeds the applicant’s planned period of stay in the United States by at least six months.
- Two nonimmigrant visa photos, two inches/50 X 50 mm square, showing the full face, on a light background)
- Proof of financial assistance (Form I-134 affidavit for assistance can be requested.)
- Payment of taxes
Useful tips
- The consular officer may request additional information. It is a good idea to bring wedding photos and other evidence that the wedding is real.
- Foreign language documents must be translated. During the visa interview, bring clear and legible photocopies of civil status documents, such as birth and marriage certificates. The original documents can then be returned to you
